Chicago Expungement Attorneys

Even a slight lapse in judgment can lead to a criminal conviction, which has serious implications for your future. You may experience challenges in passing an employment background check, renting a home, or working through the immigration process. Fortunately, you may have options for post-conviction relief, including expungement of your criminal record. However, there are strict eligibility requirements for expunging past criminal history and the proceeding may not be available in all cases.

Due to the extremely complicated nature of post-conviction rules, it’s essential to work with a knowledgeable attorney that has experience in this niche of Illinois law. Post-conviction relief lawyer Jonathan Minkus has represented the interests of many clients with various types of convictions, fighting for expungement and other remedies. Please contact our Chicago or Skokie offices to schedule a case evaluation about your specific situation. You may also find the following general information on expungement to be useful.

Eligibility for Expungement in Illinois

You may petition the court to expunge your criminal record only if you were arrested, but never convicted of a crime, AND:

  • The arrest you seek to expunge resulted in acquittal, dismissal of the charges, or you were released without the filing of charges;
  • The conviction was later vacated or reversed;
  • You received and completed the terms of an order of supervision; OR,
  • You received an order of probation and successfully completed the terms.

The Expungement Process

Mr. Minkus will assist you with the proceedings by filing a Request to Expunge and Impound Criminal Records, along with the supporting documentation. It’s necessary to include all details about your arrest and the charges, including the State’s Attorney, police department, and other officials involved with the case. This petition is core to your success with expungement, so Mr. Minkus will ensure that the filing is accurate and complete.

How Expungement Affects Your Criminal Record

If successful in your petition for expungement, you no longer have a criminal record and it’s as if the arrest never happened. All documents related to your history are physically destroyed or returned to you, and your name will no longer appear on any official records. You are no longer required to list past criminal activity when applying for jobs, on apartment rental agreements, or any filings in connection with immigration proceedings.
